Resolving Disputes Differently

At Nortons, we believe that not every dispute needs to be fought out in a courtroom. That is why we have established the Nortons Mediation Hub — a service offering clients a faster, more cost-effective, and more constructive path to resolving disputes.

No matter what type of legal dispute you are facing, mediation offers a way forward that preserves relationships, protects confidentiality, and puts you in control of the outcome.

Why Choose Mediation?

Mediation is a voluntary, confidential process in which an independent, trained mediator helps parties in a dispute reach a mutually acceptable resolution — without the need for a judge to impose a decision. It has become one of the most effective tools in modern dispute resolution, and for good reason:

Speed — Litigation can take years to reach a final outcome, whereas disputes can often be resolved through mediation within a matter of days or weeks.

Cost-effectiveness — By avoiding prolonged litigation — with its inevitable high costs and drain on management time — mediation is typically far less expensive than traditional litigation.

Confidentiality — Unlike court proceedings, which are generally a matter of public record, mediation is a private process unless the parties agree otherwise.

Control over the outcome — In litigation, a judge decides the result in which there is inevitably a "winner" and a "loser". In mediation, the parties craft the outcome with the assistance of the mediator, which means that it is more likely to be practical, tailored, and accepted by all parties.

Preserving relationships — Mediation is collaborative rather than adversarial and is therefore particularly helpful where the parties need to continue working or dealing with one another in future.

Flexibility — Mediation can accommodate creative solutions that cannot necessarily be ordered by a court.

Our Mediation Services

The Nortons Mediation Hub can assist clients in two ways:

1. Referral to Mediation

If you are involved in a dispute and would like to explore mediation as an alternative to litigation, our team can guide you through the process. We will:

—

Assess whether your matter is suitable for mediation.

—

Advise you on the mediation process and what to expect.

—

Assist in identifying and approaching an appropriate independent mediator with suitable skills and experience applicable to your dispute.

—

Represent and support you throughout the mediation process, protecting your interests while working towards a resolution.

2. Acting as Mediator

Our mediators are also available to act as independent, neutral facilitators in disputes. As mediators, we do not represent either party — our role is to guide the parties through a structured process designed to help them reach their own agreed resolution.

Is Mediation Right for Your Dispute?

Mediation is well suited to a wide range of disputes, including commercial and contractual disagreements, shareholder and partnership disputes, and workplace and employment matters. If you are unsure whether mediation is appropriate for your situation, we welcome the opportunity to discuss it with you.
